1. Acceptance of Terms

By accessing or using the KAVAYA INFOTECH website, any KAVAYA product (including Yaan Drishya), or by engaging us for custom project work, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or products.

2. Who We Are

KAVAYA INFOTECH PVT. LTD. ("KAVAYA," "we," "us," or "our") is a technology company based in Jaipur, Rajasthan, India, building custom software, websites, mobile apps, SaaS products, and smart mobility platforms.

3. Using Our Website

You may browse our website and use the contact, careers, newsletter, and custom-project forms for their intended purpose — to communicate with us. You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Submit false, misleading, or malicious information through our forms

4. Using Our Products

5. Custom Project Work

Where KAVAYA is engaged to build a custom website, app, or software product for a client ("Custom Project"), the specific scope, timeline, deliverables, and payment terms for that engagement will be set out in a separate written agreement or proposal between KAVAYA and the client. These general Terms apply in addition to that agreement; in case of conflict, the specific project agreement takes precedence. Submitting an idea through our "Custom Projects" form does not, by itself, create a binding contract — it begins a conversation, and any engagement is formalized separately.

6. Accounts & Acceptable Use

Some KAVAYA products and services require you to create or use an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you believe your account has been accessed without authorization, you must notify us promptly.

  • Provide accurate, complete, and up-to-date account information.
  • Keep your password and account credentials secure.
  • Use your account only for lawful and authorized purposes.
  • Respect the privacy, security, and rights of other users.
  • Access only the data, features, and resources you are authorized to use.
  • Comply with all applicable laws, regulations, and these Terms.

You must not:

  • Share, sell, rent, or transfer your account to another person without our permission.
  • Attempt to gain unauthorized access to any account, system, network, or data.
  • Interfere with the operation, security, or performance of any KAVAYA product or service.
  • Use our products to distribute malware, spam, fraudulent content, or any material that is illegal, harmful, or infringes the rights of others.

We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner that compromises the security, integrity, or proper operation of our products and services.

7. Intellectual Property

All content on this website — including text, design, graphics, logos, and the underlying code — is the property of KAVAYA INFOTECH PVT. LTD. unless otherwise noted, and is protected by applicable intellectual property laws. For Custom Project work, ownership and licensing of deliverables (such as final source code or designs) will be specified in the relevant project agreement. Unless otherwise agreed in writing, KAVAYA retains rights to general methodologies, reusable components, and know-how developed during a project.

8. Payments & Fees

Where applicable, fees for Custom Project work, product subscriptions, or other paid services will be set out in a separate proposal, invoice, or agreement. Payment terms, milestones, and refund conditions (if any) will be specified at that time. We do not store full payment card details on our own systems; payments are processed through trusted third-party payment providers where applicable.

9. Disclaimers

Our website and products are provided on an "as is" and "as available" basis. While we work hard to keep information accurate and systems reliable, we make no warranties — express or implied — regarding uninterrupted availability, error-free operation, or fitness for a particular purpose, except as explicitly agreed in a separate written contract for Custom Project work.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KAVAYA INFOTECH PVT. LTD. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim relating to a Custom Project will not exceed the fees actually paid by the client for that specific project, unless otherwise agreed in writing.

11. Termination

We may suspend or terminate access to our website or a product for any user who violates these Terms, engages in unlawful activity, or misuses the platform. For Custom Project engagements, termination terms will be specified in the relevant project agreement.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our website or products will be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.

13. Changes to These Terms

We may update these Terms of Service from time to time. We'll update the "Last updated" date above when we do. Continued use of our website or products after changes take effect constitutes acceptance of the revised Terms.
